Arvind Kejriwal misleading people by misquoting the judgement in Benami Transaction

Arvind Kejriwal, Delhi Chief Minister, stated on Twitter on October 10, 2022, that the Delhi High Court has dismissed the case against Satyendra Jain while hailing the court. In his tweet, he targeted GOI and Central Agencies by saying that they had jailed an honest guy for so long under duress. Instead of bringing false charges, these people should devote their time and effort to strengthening the country.

Due to extremely shady past of the imprisoned Delhi Minister Satyendra Jain and the numerous accusations that had been charge against him recently while he was on the ED’s radar, and the fact that Jain continues to remain behind bars, our team conducted research to verify the statement given by Kejriwal in his tweet.

In our research, using the keyword search “Satyendar Jain“, we came across a report by Economic Times. As per the report, the Delhi High Court on Monday closed all proceedings under the Benami Transaction (Prohibition) Amendment Act against the former Health Minister of Delhi.

It further mentions that Jain submitted the petition in 2017 and said the alleged transactions occurred between March 2016 and November 2016 and as a result, the amendment that took effect in November 2016 would not apply. The Delhi High Court ruled last month that Satyendra Jain will not face any coercive or other government action in accordance with the revised benami statute.

On the basis of a CBI FIR filed in 2017, the Enforcement Directorate has also accused Jain of money laundering in a case that is now being heard in a trial court. He is charged in the FIR submitted under the Prevention of Corruption Act. In accordance with the provisions of the Prevention of Money Laundering Act, Jain taken into custody by the ED on May 30.

The ED conducted a search at the offices of Satyendar Jain on June 6, 2022, and several incriminating papers and digital recordings were discovered, according to an ED press statement dated June 6, 2022. A total of 133 gold coins weighing 1.80 kg and cash totaling Rs 2.85 Crore were discovered.

In his tweet, Kejriwal tried to mislead the people by emphasizing that Jain had been cleared of all charges, including the money laundering case. However, Satyendra Jain’s case under the Benami Transaction Amendment Act was recently closed. He is still facing charges of money laundering, which the court is presently hearing. Additionally, according to the TOI report from October 10, 2022, the Supreme Court announced on Monday that it would hear a petition submitted by Delhi minister Satyendar Jain on Tuesday. The petition was filed in opposition to the Delhi High Court’s decision to deny his request to have a lower court transfer the money laundering case in which he is currently detained to a different court.
