On social media platform X, formerly known as Twitter, an inundation of tweets from Congress party supporters alleges that the Supreme Court of India has severely criticized the Modi government regarding the demonetisation issue. These tweets suggest that the Supreme Court has described demonetization as a strategy used by the government to transform illicit funds into legitimate assets.

Congress party supporter Ankit Mayank said, ‘Bélt trèatment by Supreme Court to Modi Govt on Demonetisation SC observed that Demonetisation was done in such haste that no due process was followed, hence making it illegal as per law. SC also highlighted that no suggestion, no advice was taken from even the Finance Minister, perhaps even he didn’t know about it. CJI further concluded that 𝗗𝗲𝗺𝗼𝗻𝗲𝘁𝗶𝘀𝗮𝘁𝗶𝗼𝗻 𝘄𝗮𝘀 𝗱𝗼𝗻𝗲 𝗼𝗻𝗹𝘆 𝘁𝗼 𝗰𝗼𝗻𝘃𝗲𝗿𝘁 𝗯𝗹𝗮𝗰𝗸 𝗺𝗼𝗻𝗲𝘆 𝗶𝗻𝘁𝗼 𝘄𝗵𝗶𝘁𝗲 𝗺𝗼𝗻𝗲𝘆. Shockwaves to Modi Govt, unexpected SummerSlam right before the Loksabha polls. Fact Check

Our investigation started with a Google search utilizing pertinent keywords associated with the subject matter. Subsequently, we stumbled upon an article released by Bar and Bench on March 30th, 2024. As per the article, Supreme Court Justice BV Nagarathna addressed attendees during the inaugural session of the Courts and the Constitution Conference, which was hosted by NALSAR University of Law, Hyderabad.

Justice BV Nagarathna said on demonetisation, “I am happy that I got to be part of that bench. We all know what happened on November 8, 2016. 86% of the currency was 500 and 1,000 notes, which I think the Central government lost sight of. Imagine a labourer who had to get his notes exchanged for daily essentials. 98% of the currency came back, so where are we in black money eradication (goal of demonetisation)? So I thought (at the time) it was a good way of making black money white money, of unaccounted cash entering the system. What happened with regard to income tax proceedings thereafter, we do not know. So this common man’s predicament really stirred me and I had to dissent.”

During her address, Justice BV Nagarathna discussed her dissenting stance regarding the Supreme Court’s ruling on demonetisation issued in January 2023. Notably, Justice Nagarathna was a member of the five-justice bench that delivered the judgment.

 According to the Indian Express Article published on January 5, 2023, “A Constitution Bench of the Supreme Court Monday upheld by a 4:1 majority the decision taken by the central government six years ago in 2016 to demonetise currency notes of Rs 500 and Rs 1,000 denominations. The majority, comprising Justices S Abdul Nazeer, B R Gavai, A S Bopanna, V. Ramasubramanian, held that the Centre’s notification dated November 8, 2016, was valid and satisfied the test of proportionality. Justice BV Nagarathna in her dissenting view held that though demonetisation was well-intentioned and well thought of, it has to be declared unlawful on legal grounds (and not on the basis of objects).”

Therefore, Justice BV Nagarathna expressed her dissenting viewpoint on demonetisation during a private event hosted at NALSAR University of Law, Hyderabad. She was joined by a few other judges who also addressed the gathering. It’s important to note that during the event, Justice Nagarathna conveyed her personal opinion rather than representing the entire Supreme Court. It should be noted that in January 2023, the Supreme Court had already upheld the central government’s decision on demonetization, calling it “valid and meeting the test of proportionality.”
