The opposition party has been accusing the BJP party of misusing CBI and ED to muzzle opposition amid the CBI investigation into Deputy Chief Minister of Delhi Manish Sisodia’s residence in the liquor scam.

On August 31, 2022, Congress Sevadal’s Twitter account in a tweet accused the BJP party of misusing constitutional institutions. They stated that every institution’s autonomy is being attacked, whether it is the RBI, EC, ED, CBI, or SC. The democratic ideals are being blatantly destroyed. In a tweet they attached an ordered from the Supreme Court to close Gujarat 2002 riots cases and tried to imply that the BJP party was complicit in the decision and had misused its authority, which caused the Supreme Court to give this ruling.

Fact Check

Our Only Fact conducted research to determine why the Supreme Court had ordered the Gujarat 2002 riots proceedings to be closed. In our research, we established that the Supreme Court has dismissed all pending petitions related to the riots in Gujarat in 2002, citing the fact that the cases had grown “infructuous with the passage of time.”

As per the India Today report, a panel led by Chief Justice of India UU Lalit remarked that there is just one trial ongoing in the Naroda Gam matter. In 8 of these 9 cases, the trial has been ended by trial courts, senior advocate Mukul Rohatgi representing the SIT said. He stated that only the Naroda Gaon case’s trial, adding that it is currently in the latter stages of arguments.

Through our research, we established that the Gujarat Riots 2002 proceedings have been closed by the Supreme Court because 8 out of 9 cases have reached a verdict. The Naroda Goan proceeding is nearing completion and will soon be over. The BJP has no influence on Supreme Court rulings. It is a really flimsy argument to associate the Supreme Court decision to the BJP party. Exaggerating the cases will be a waste of time because the judgement has already been rendered.
